AI‑generated victim video forces Arizona killer to be resentenced
An Arizona court has ruled that a 10‑year sentence for Gabriel Horcasitas must be set aside because an artificial‑intelligence‑created video of the victim’s voice was improperly admitted in the original trial.
Horcasitas, 55, was found guilty by a jury of shooting 37‑year‑old Christopher Pelkey during a red‑light confrontation in 2021, and was sentenced to a decade in prison. During the sentencing hearing, Pelkey’s sister, Stacey Wales, had submitted an AI video that recreated Pelkey’s voice and appearance, delivering a message about forgiveness and the possibility of a different outcome if circumstances were different.
Horcasitas’s attorneys challenged the admissibility of the clip, arguing that it was a fabricated representation rather than a factual record. The Arizona Court of Appeals agreed, holding that the AI rendering “crossed the line” by presenting a fictionalized depiction of the victim and his thoughts created from Wales’ imagination.
The court’s decision means Horcasitas will be resentenced and highlights the legal world’s growing scrutiny of AI evidence in criminal trials.
The court noted that the judge at the original sentencing had praised the AI video, remarking that he found the “forgiveness” message genuine, but the appeals panel held that such opinion‑driven material cannot be used to influence sentencing.
