A federal judge has annulled the trial scheduled for Kilmar Abrego Garcia, the Salvadoran man mistakenly deported by the Trump administration. The case has drawn significant public interest, particularly regarding its implications for immigration policy.

Following his deportation to El Salvador—where he faced threats from gangs—Abrego Garcia was brought back to the U.S. under pressure from a court order. Upon his return, he was met with human smuggling charges filed in Tennessee, which he vehemently denies, claiming vindictive targeting by prosecutors.

Federal Judge Waverly D. Crenshaw Jr. acknowledged the substantial evidence presented for a hearing, which he scheduled for January 28. The upcoming hearing will require prosecutors to justify their decision to pursue charges against Abrego Garcia, and if they fail to provide adequate reasoning, the case may be dismissed.

Garcia's troubles began after a traffic stop in 2022 when officers noted suspicious activity involving the vehicle, although ultimately, he was only given a warning.
