Judge Rules Department of Defense Unlawfully Retaliated Against AI Startup Anthropic

U.S. District Judge Rita Lin has ruled that the Pentagon’s designation of Anthropic as a supply‑chain risk was illegal and baseless, constituting unlawful retaliation.

The decision followed Anthropic’s refusal to allow the Department of Defense to use its AI models for surveillance or autonomous weapons, prompting a legal challenge.

Judge Lin dismissed the Pentagon’s claim that the move was justified by national‑security concerns, noting that "citing national security is not a blank check to punish and retaliate against government critics."

Anthropic welcomed the ruling, saying it continues to seek productive collaboration with the U.S. government to harness AI for national security, while warning that its models are "not reliable enough to be safely used in weapons systems" or for domestic surveillance.

The court further found that forcing companies that do business with the U.S. military to boycott Anthropic constitutes unlawful conduct, effectively "crippling" the company and chilling public debate on AI in defense.

The Pentagon had earlier labeled Anthropic a supply‑chain risk in February, the first time an American company received that designation. The White House had also called the startup a "radical left, woke company" attempting to control military activity, which the court rejected as a First Amendment attack.
