AI‑Generated Victim’s Testimony Halts Arizona Road‑Rage Killer’s Sentence

An Arizona court of appeals has ordered a new sentencing hearing for Gabriel Paul Horcasitas after it ruled that an AI‑generated video of the victim, Christopher Pelkey, was improperly introduced during the 2024 sentencing.

Horcasitas, 55, was found guilty of shooting Pelkey—then 37—at a red light in 2021 and received a ten‑year prison term. During the sentencing, the jury witnessed a family‑made AI rendering that depicted Pelkey expressing forgiveness toward his killer.

The appeals panel concluded the video “crossed the line” by presenting a depiction of the victim’s thoughts created from the imaginations of Pelkey’s sister, rather than an objective record of the event. Judge Todd Lang had praised the emotional impact of the clip during the original sentencing, but the higher court disagreed with its admissibility.

The family built the AI piece using Pelkey’s voice recordings, photographs and other media to recreate his appearance and message. The clip’s content highlighted Pelkey’s belief in forgiveness and his desire for what might have been.

Horcasitas’ legal team, led by Kristen Reller, had appealed on the basis that the AI presentation violated sentencing guidelines. The court’s decision now means the defendant will face a new sentencing hearing, and the case raises critical questions about the admissibility of AI‑generated evidence in U.S. courts.
